TERMS AND CONDITIONS OF NORD’S GIFT WITH PURCHASE PROMOTION IN ITALY

These are the Terms and Conditions of Nord’s Gift with purchase promotion in Italy (“Promotion”). By participating in this Promotion, you agree to these Terms and Conditions, which are a binding contract between you and nordvpn S.A. (“Nord”), so please read them carefully before entering.

1. Eligibility.

This Promotion is open to all individual legal residents of Italy, provided they meet the specified eligibility criteria outlined below:

  • Participants must be aged eighteen (18) years old or over (at the time of purchase);
  • Participants must purchase a two (2) year plan of NordVPN Services (as defined in Section 1.1 of the General Terms of Service) that is reflected on the NordVPN website (“Two-Year Plan”) during the Promotion Period (as defined below in Section 2); and
  • Participants must maintain the purchased Two-Year Plan subscription for more than thirty (30) days (i.e., not request a refund for the purchased Two-Year Plan as per “Money Back Guarantee” terms outlined in Section 6.2 “Refund” of the General Terms of Service).

For the purposes of these Terms and Conditions, individual(s) who meet the above criteria is(are) referred to as “Participant” or “Participants”.

Promotion is not valid with any other Nord’s offers/promotions. Employees of Nord, its subsidiaries, affiliates, and parent companies, or anyone associated with the administration of this Promotion are not eligible to participate.

Purchase of a Two-Year Plan is necessary. No entry fees apply to be eligible for the Promotion.

2. Promotion period.

The Promotion starts on 2 May 2024 at 11am Central European Time (“CET”) and ends on 30 May 2024 at 11am CET (“Promotion Period”). The timekeeping device used by Nord is the official clock of the Promotion.

3. Gift.

Upon successful purchase of the Two-Year Plan within the Promotion Period, each verified and confirmed Participant (who meets the following eligibility criteria as specifically defined herein) will (i) receive a 3-month additional plan subscription, and (ii) be awarded with one (1) Gogift global gift card. The value of them depends on the purchased plan and marketing channel:

  • For the Basic plan (or its equivalent) – the 3-month (or 4-month if purchased through influencers) additional Basic plan subscription and the Gogift global gift card worth EUR 10 (ten euros).
  • For the Plus plan (or its equivalent) – the 3-month (or 4-month if purchased through influencers) additional Plus plan subscription and the Gogift global gift card worth EUR 20 (twenty euros).
  • For the Ultimate plan (or its equivalent) – the 3-month (or 4-month if purchased through influencers) additional Ultimate plan subscription and the Gogift global gift card worth EUR 50 (fifty euros).

The specific 3-month (or 4-month) additional plan subscription together with the particular Global Gift Card collectively hereinafter referred to as “Gift” or “Gifts”.

Please review GoGift Terms and Conditions, as well as other documents carefully and make sure you clearly understand them before you redeem or otherwise use the Gogift global gift card.

The Participant may not exchange the Gift for cash, other items, or services. Nord does not assume responsibility for lost or stolen (i.e., redeemed Gogift global gift card without the Participant’s permission) Gifts for reasons beyond the Nord’s fault, and replacements will not be provided. The Gift is as stated and nothing else is included.

4. How to Enter and Gift Delivery.

During the Promotion Period, all Participants meeting the criteria set forth above in Section 1 will be eligible to receive/be awarded with the Gift.

In any case, the Gift will be delivered after the expiration of the Money Back Guarantee period (as defined and explained in Section 6.2 of the General Terms of Service). For the avoidance of doubt, provided that the 30-day period of the Money Back Guarantee period has expired without the subscription being cancelled, all eligible Participants will automatically:

  1. First, receive 3-month additional plan subscription by Nord adding it to the Participant’s purchased Two-Year Plan, and details about it will also be displayed in the Participant’s Nord account, and
  2. Second, be awarded with the Gogift global gift card by Nord sending it to the Participant via email within fifty (50) calendar days of the Participant’s purchase of Two-Year Plan.

The precise validity period of the the Gogift global gift card can be verified at any time at the Gogift website available at https://www.support.gogift.com/.

No more than one (1) Gift per Participant: anyone attempting to enter more than once (including, without limitation through multiple accounts or email addresses) will be disqualified.

5. Privacy.

All information collected or otherwise processed in respect to you as part of the Promotion shall be subject to Nord’s Privacy Policy.

6. Release and Limitation of Liability.

If the Promotion is not capable of running as planned for reasons outside control of Nord (including but not limited to tampering, unauthorized intervention, fraud, or any other causes beyond the control of Nord that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this promotion), Nord reserves the right (subject to any written directions given under applicable law) to disallow any reward claims at its sole discretion or to cancel, terminate, modify or suspend the Promotion.

To the extent permitted under applicable law, Nord assumes no responsibility for damages, losses or injuries that result from acceptance of the Gift or participation in this Promotion.

7. Additional Terms.

Each individual participating in the Promotion was, is, and shall be bound by the General Terms of Service for the duration of the use of and access to NordVPN Services.

Nord may, in its sole discretion, disqualify any individual found to be: (i) tampering with the entry process or the operation of the Promotion or any of Nord’s websites; (ii) acting in violation of these Terms and Conditions; or (iii) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. If an entry is incomplete or if the Participant uses robotic, automatic, programmed, or similar methods, an entry will be disqualified. The authorized subscriber of the email account used to enter the Promotion at the actual time of the entry will be deemed to be the Participant and must comply with the rules set herein in the event of a dispute as to entries submitted by multiple users having the same email account. The authorized account subscriber is the natural person who is assigned an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses for the domains associated with the submitted email address.

8. Miscellaneous.

By participating in this Promotion, each Participant agrees that Nord’s decisions related to the Promotion and all distribution of Gifts are final. Any difficulties in interpreting these rules and any disputes will be settled by Nord or by the competent courts.

9. Governing Law and Dispute Resolution.

The Terms and Conditions of this Promotion shall be governed by the laws of the Netherlands and the courts of the Netherlands shall have non-exclusive jurisdiction. Notwithstanding the foregoing, in compliance with the Electronic Commerce Directive (2000/31/EC) in the EU the laws of Italy will apply for consumers’ protection purposes.
